These are the terms upon you may use our Estate Online site. Estate Online is property of UBONGO SOFT LTD, whose registered office is located at Plot 92 Kanjokya Street, Kampala, Uganda.
By using the Estate Online site, you unconditionally agree to be bound full and irrevocable by these Terms Of Business.
We advise you to consult these Terms Of Business regularly as Estate Online reserves the right to amend these terms and conditions at any time and without notice.
Rules of ad publication
The price of an ad is fixed for the publication of a specific property. The user may not, after publication, change his/her ad. It is forbidden to replace the contents of an ad which is published. To publish new content must be done by placing a new ad.
The user specifies the publishing period when he/she is placing the ad. A repayment, fully or partially, when the user removes the ad from the website before the expired period is not applicable. Estate Online will never do a repayment for such a reason and the user accepts this explicitly.
Estate Online reserves the unilateral right to deactivate or modify any ad published on the site, even before the end of the publication period, in the following cases:
- A descriptive text is contrary to these Terms of Business
- An ad relates to a property already sold or let
- Photos do not represent the property explicitly
- An ad mentions the address of another site
- An ad is misleading, e.g. in relation to its location, or an ad is illegal
Estate Online reserve the right to prohibit site access, to all or part, to any individual or legal person:
- who would violate these Terms of Business
- who would post false or illegal ads on the site
- who would infringe third-party intellectual property rights
- who would infringe third-party privacy rights, using personal data available on the site
- who would use the site illegally
Estate Online also reserve the right to take legal action against such persons.
Estate Online available 24 hours a day and 7 days a week. Nevertheless Estate Online has the right to interrupt access to the site for technical or other reasons. This may be done at any time and without notice. In case of this stop of offering services, Estate Online shall not be liable or accountable for these interruptions and for the consequences that might result for the user or for any third party.
Estate Online advises the user to install firewalls, antivirus software and other necessary protection software on his/her computer. Estate Online ensures as far as possible that the site and files that can be downloaded on it are free of unauthorized bugs, viruses and spyware. However, a 100% guarantee is not given. Estate Online can on no account be held liable for any resulting damage and/or loss to the user.
Links to third-party sites
In the Estate Online site, you may find hyperlinks to third-party materials and sites operated by third parties. We are not liable for the content of such materials or sites or for their quality or accuracy. These sites are operated under the exclusive responsibility of their respective owners, who are solely liable for complying with laws and regulations applicable to the products and services sold on their sites.
"For Sale" and "For Rent" sections
The real estate ads posted on the Estate Online site have been drafted with care and are regularly updated. However, neither Estate Online (the Estate Online site manager) nor the person or organisation (estate agent, solicitor, developer or private individual) that sent us the ad can be held liable if errors have slipped into the content of the ads or if the property is no longer available when you read the ad. An ad does not constitute a legally binding offer. Information on the website should always be treated as provisional. Information should always be checked with the estate agent, solicitor, developer, company or private individual who posted the ad.
Estate Online can on no account be held liable for the legality, accuracy and the business information. Estate Online is not liable for the description and prices of the goods on the site or for the quality of the goods and/or services in these ads.
If you post an ad on the Estate Online site, you agree to only publish content (images, photos, etc.) that does not infringe any third-party rights, including intellectual property rights (copyright, rights to images, etc.), morals or accepted standards of behaviour. You agree to indemnify Estate Online against any third-party action concerning the ad that you posted on the Estate Online site.
Liability of Estate Online related to content posted on the site by users
All text, data, photos, video, messages or other content posted on the site are the sole responsibility of the person from whom such content originates. Estate Online does not control the content posted on the site by its users and shall not be liable in any way for that content. The user agrees and guarantees that Estate Online has the right to use all text, image and information posted on the Estate Online site.
The user undertake to indemnify Estate Online (Estate Online site owner) and its subsidiaries, officers, employees, partners and agents against any claim made by any third party against it arising out of any content whatsoever the user submit to the site.
Estate Online – UBONGO SOFT Ltd is the exclusive owner of intellectual property (such as copyrights or rights of the creator of databases) on all content included on the Estate Online site.
The user has the right to register on the Estate Online site by filling out a form with your personal data. The free services available after registration are :
- saving search criteria for properties
- linking to the properties you are interested in
- saving a personal comment to the properties you are interested in
Your password is personal and confidential. You are solely responsible for its use. The user is fully and solely responsible for any activity carried out using his/her password.
Applicable law and jurisdiction
These terms of business are subject to the laws of Uganda. Any dispute shall be subject to the exclusive jurisdiction of the Kampala courts. If a court rules that any provision of these Terms is invalid or unenforceable this will not affect the validity of the rest of the Terms which will remain in force.
